The firm provides legal counsel services to more than fifty public sector benefit fund and labor union clients, located in New York City and the surrounding areas, including, but not limited to:
- Providing counsel and advice to the Trustees, officers, and staff of these entities on their fiduciary responsibilities and protecting that status.
- Rendering written legal opinions and keeping clients advised of changes in the law governing the operations of employee benefit plans, including but not limited to COBRA, HIPAA, FMLA, the ACA, Federal, state and municipal employment and labor laws, the Internal Revenue Code, and New York State Insurance Law.
- Drafting trust documents and benefits booklets/summary plan descriptions, policies, procedures, and rules for benefit funds and plans.
- Attending Board of Trustees and committee meetings and preparing official minutes memorializing discussions and policy actions.
- Reviewing and negotiating agreements with all administrators and vendors doing business with clients, and if necessary, instituting legal proceedings to enforce their rights under such agreements.
- Public Employee Plan Perspective – As experts in representing benefit plans that cover public employees, we pay close attention to the difference between 'ERISA' terminology governing private sector plans and non-ERISA governance (insurance law, local statute, and collective bargaining agreements).
